Eligibility

1. NEWKINGSCO service is intended for users who are 12 years of age or older. Any registration by, use of or access to the service by anyone under 12 years of age requires permission from a parent or legal guardian, who must read these Terms and Conditions and Privacy Policy and agree to be bound by them, on behalf of their minor child consent from their Parent or Guardian.

   • NEWKINGSCO reserves the right to confirm that such permission has been granted and to close or restrict any Athletes until NEWKINGSCO is satisfied that a parent or legal guardian has read the Terms and Conditions and agrees to allow their minor child to hold an account.

PERMISSIONS:

• I hereby grant permission to NEWKINGSCO, the rights of my image, in video or still, and of the likeness and sound of my voice as recorded on audio or video tape with NO payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area. Photographic, audio or video recordings may be used for ANY USE which may include but is not limited to: • Presentations; • Courses; • Online/Internet Videos; • Media; • News (Press); By signing this release, I Name understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting. I Name will be consulted about the use of the photographs or video recording for any purpose other than those listed above. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio or video recordings collected as part of the sessions listed on this document only. By signing this release, I Name acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for educational purposes

• I the undersigned, in consideration for my voluntary participation in organized soccer, do hereby willfully acknowledge that my signature below attests to my understanding and agreement that:

CONDUCT:

• My player status will be kept in good standing. I will not compromise myself in such a way as to do harm to the league or tournament, knowing that players may be dismissed from participation, with possible loss of payment or dues, for violent conduct or unsportsmanlike behavior on or off the field of play. I agree to pay for any and all damages to any property or indemnities caused by me willfully, negligently, or otherwise.

• Soccer is a physical, contact, sport that involves the risk of injury. I assume all risks and hazards associated with my participation in the sport. I am in proper physical condition to participate in soccer practices and games and have no illness, disease or existing injury or physical defect that would be aggravated by my participation. I will inform my coach if this status changes. I further acknowledge that this risk may involve loss or damage to me or my property, all illness, disability, including the risk of death, or other unforeseen consequences, including those which may be due to the unavailability of immediate emergency medical care. I have a current medical consent form in force. I will wear shinguards, properly-fitted and appropriate shoes, and other protective equipment (e.g., mouth-pieces), as provided by soccer rules, to all events.

 

 

Changes

• NEWKINGSCO reserves the right, at any time and at our sole discretion, to change or modify these Terms and Conditions applicable to your use of the NEWKINGSCO service, or any part thereof, or to impose new terms, including, but not limited to, adding fees and charges for use. Unless stated otherwise, any change takes effect immediately. You are responsible for ensuring you are familiar with the latest terms. By continuing to use NEWKIMNGSCO website, you agree to be bound by these changes.

Intellectual Property

• The NEWKINGSCO Service and each Website are owned and operated by NEWKINGSCO. All content, trademarks and other proprietary materials and/or information on NEWKINGSCO, including, without limitation, NEWKINGSCO logos, the visual interfaces, graphics, design, compilation, information, software, computer code (including source code or object code), services, text, pictures, photos, video, graphics, music, information, data, sound files, other files and the selection and arrangement thereof and all other materials are protected by copyright and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws (including in your country of residence).

By submitting content to NEWKINGSCO, you are agreeing and bound by the conditions that

  • Your submitted content does not contain personally identifiable information about other persons, such as their phone number, identifiable pictures, contact information or email address, or information about that could result in an invasion of their privacy or their harassment.

  • You grant us a non-exclusive, royalty-free, perpetual, irrevocable and fully assignable and sub-licensable right to use, reproduce, modify, adapt, publish, translate, edit, reformat, create derivative works from, distribute and display content throughout the world for any purpose and in any media (including for advertising or other commercial use).

  • You grant us the non-exclusive right to seek to enjoin and/or obtain damages from any third party from the unauthorized use or reproduction of your content. If we publish your content or authorize or license others to do so, your content may be edited for length or clarity or for any other reason either before or after it is published. • Any material downloaded or otherwise obtained by you through the NEWKINGSCO service or any product is done at your own discretion and risk. You will be solely responsible for any damage or potential damage to your computer system and/or console or loss of data that results from the acquisition of any such material.

• You agree that we cannot be held liable if laws applicable to you restrict or prohibit your participation in our competitions. We make no representations or warranties, implicit or explicit, as to your legal right to participate in any online competition offered by NEWKINGSCO, nor shall any person affiliated with or claiming affiliation with NEWKINGSCO have authority to make any such representations or warranties.

• We make no representation or warranty that the Website or Underlying System is appropriate or available for use in all countries or that the content satisfies the laws of all countries. You are responsible for ensuring that your access to and use of the Website or Underlying System is not illegal or prohibited, and for your own compliance with applicable local laws.

• Any threat of legal action against NEWKINGSCO will likely result in your account/team being permanently removed from the Website and Underlying System.

• We reserve the right to refuse service to anyone for any reason.

• I am well aware that the participation of participant may have possible exposure to and illness from infectious diseases including but not limited to influenza, COVID-19, MRSA. I acknowledge that there is rules in place to reduce the spread of the illness but the risk of serious illness and death does exist including participant and anyone they come into contact with.

• NEWKINGSCO Programs does not have personal injury insurance that covers my participation. Therefore, I should have a current, active, personal injury insurance that covers my participation. Therefore, I should have a current, active, personal injury insurance policy in force, which covers my participation. Under any condition, I am responsible for any and all medical expenses arising from my participation, games. I have the right and responsibility to inspect the equipment and facilities prior to events and, if i believe that anything may be unsafe, I will advise the coach or supervisor of the condition and may refuse to participate. Participation assumes consent.

• I hereby release, waive liability, discharge, hold harmless, indemnify, and covenant not to sue, NEWKINGSCO Professional Sports Instructors., the team and facility in use, their associated directors, administrators, officers, managers, employees, coaches, trainers, volunteers, sponsors and advertisers, and other agents, estates or executors, from any and all liability incurred in the conduct of, and my participation in, thier soccer programs.

• I have completely read this document and fully understand its contents, I acknowledge that I have given up substantial rights by accepting this document and that I do so voluntarily. By checking “Agree to the terms“, I attest to this on behalf of myself and my executors, personal representatives, administrators, heirs, next-of-kin, successors, and assigns.

•  

• I knowingly and willingly consent to have emergency dental treatment completed during the COVID-19 pandemic.

• I understand the COVID-19 virus has a long incubation period during which carriers of the virus may not show symptoms and still be highly contagious. It is impossible to determine who has it and who does not given the current limits in virus testing.

• Dental procedures create water spray. It is unclear as to how long the ultra-fine nature of the spray may linger in the air, which can transmit the COVID-19 virus.

• I have been made aware of the CDC and ADA guidelines that under the current pandemic all non-urgent dental care is not recommended. Dental visits should be limited to the treatment of pain, infection, conditions that significantly inhibit normal operation of teeth and mouth, and issues that may cause anything listed above within the next 3-6 months.

• I confirm that I am not presenting any of the following symptoms of COVID-19 listed below:

  • Fever

  • Shortness of Breath

  • Loss of Sense of Taste or Smell

  • Dry Cough

  • Runny Nose

  • Sore Throat
